Terms of Service

All TW Agency Services 

1.    Please note TW Agency check each Court lists each morning and will amend the booking time for your matter as required. You do not need to update us with this information.
2.    We make best efforts to mention your matter at the earliest opportunity.
3.    Should you experience any problems with our booking system, please contact our friendly staff on 0481 333 141.
4.    Please complete all fields marked with *.
5.    Please note, no refund of any payments are made under any circumstances.
6.    If the Court cancels your listing for the date in question, we will attend on the following listing date advised as by you.
7.    If your instructions are inadequate or unprofessional, we will communicate same to you as soon as practicable. We reserve the right to withdraw our services in these circumstances. Your tax invoice will remain due and payable with respect to our costs of seeking your further instructions and advising you accordingly.

Consent Matter Rates

10.    Consent Matters may include but are not limited to;
a.    Attached Minute of Consent Orders signed by all parties;
b.    Authority to mention your appearance and your opponent and to make orders as provided by you; and
c.    Unsigned Orders that have been agreed to by all parties. 
11.    The price of is for attendance by one of our agents for the first hour only. If the matter exceeds one hour, you will be charged the consent rate per hour thereafter at six-minute increments. You will receive a secondary invoice upon conclusion of your matter. You hereby agree to pay any such additional invoice within 7 days of the date of invoice.
12.    If you select a consent invoice and the matter is contested or delayed, we reserve the right to issue you any additional invoice for the services actually provided. You hereby agree to pay any such additional invoice within 7 days of the date of invoice. 

13.    To benefit from "pay now" rate, of $220.00 for first hour, and $220.00 per hour in 6 minute increments thereafter, payment must be made in the amount of $220.00 (inclusive of GST) for the first hour at the time of booking. 

Contested Matter Rates

14.    Contested Matters include circumstances where we are required to negotiate the orders with your opponent or advocate with the Court on your behalf. 
15.    The price is for the first hour only. If the matter exceeds one hour, you will be charged the Contested rate per hour thereafter at six-minute increments. You will receive a secondary invoice upon conclusion of your matter. You hereby agree to pay any such additional invoice within 7 days of the date of invoice.

16.    To benefit from "pay now" rate, of $275.00 for first hour, and $275.00 per hour in 6 minute increments thereafter, payment must be made in the amount of $275.00 (inclusive of GST) for the first hour at the time of booking. 

Document Services & Other Services

17.    The prepaid administration fee is for our attendance/engagement. 
18.    If bookings require completion within 24 hours, the ‘Urgent Admin Fee’ applies.
19.    In additional to the administration fee, you will be charged;
a.    $1.10 (inclusive of GST) per page copied;
b.    $275 (inclusive of GST) in six-minute intervals for document inspection and report preparation; and 
c.    Attending to pick up and delivery. 
20.    There is no delivery charge for documents sent by DX or are provided in electronic form. 
21.    All other postal services may incur additional costs which you hereby agree to pay within seven days of the date of invoice.
